Barry Howard

Barry Howard has practiced law for 30 years. During that time his practice has primarily consisted of representing parties in all types of civil litigation with an emphasis on personal injury, professional liability and business litigation. As a practicing attorney he has participated in over two hundred mediations as the attorney representing a party in the litigation. This has given him a unique opportunity to observe and learn from many of the better mediators throughout the state.

Mr. Howard is a Tennessee Supreme Court Rule 31 listed civil mediator. As a mediator he has mediated personal injury, medical malpractice and commercial disputes. The scope of these mediations includes catastrophic injury cases, multi-million dollar commercial transactions, wrongful death claims and numerous less severe personal injury cases.

Mr. Howard is a member of the Tennessee and Nashville Bar Associations, Nashville Bar Foundation, International Association of Defense Counsel and Defense Research Institute. He has lectured and taught continuing education courses on a variety of topics including mediation for the TBA, TDLA, NBI, Lorman, Cumberland School of Law, Insurors of Tennessee, NALS, and various insurers.

William H. Tate

Bill Tate is a Rule 31 Listed Civil Mediator. His mediation practice focuses on construction litigation, insurance coverage of construction disputes, bankruptcy and commercial litigation. Mr. Tate has practiced law in Nashville, Tennessee for the last twenty-nine years, working on construction and insurance coverage under the Commercial General Liability Policy and the Builders Risk Policy. Mr. Tate has spent much of his career litigating and negotiating bankruptcy matters, including construction cases involving Surety issues, construction issues and financial issues.

Mr. Tate has served as a mediator in construction cases, bankruptcy and insurance matters and has participated in mediations involving wrongful death claims, copyright and trademark issues.

Mr. Tate has lectured on insurance coverage of construction disputes and has advised clients regarding insurance coverage of entertainment matters, including copyright infringement. Recently, Mr. Tate has been a featured speaker for the Tennessee Association of Construction Counsel and the Tennessee Bar Association Law Section on the topic of Insurance Coverage of Construction Disputes in Tennessee.

Kenneth M. Switzer

Kenneth M. Switzer is a graduate of the University of Louisville School of Law and was admitted to the Bar of the State of Tennessee in 1977. He was admitted to practice before the United States Supreme Court in October of 1983. Mr. Switzer has been a Rule 31 Approved Mediator since 1999 and has focused his mediation practice in the areas of appellate mediation and personal injury, medical malpractice and product liability mediation. He has also mediated several business disputes in the past eight years. He is a Board Certified Civil Trial Specialist. He has represented both plaintiffs and defendants in his thirty years of practice of law and has specialized in the areas of personal injury, medical malpractice, product liability and workers’ compensation. He is presently a candidate for a Masters Degree in Conflict Management from Lipscomb University and is a member of the Tennessee Association of Professional Mediators.
