Denial of Unisured Motorist Benefits Upheld

Alan M. Sowell and Nathaniel Cherry recently obtained a favorable decision from the Tennessee Court of Appeals in the case of Hamrick v. Lewis, No. E2007-02414-COA-R3-CV, 2008 WL 5263620 (Tenn.Ct.App. Dec. 18, 2008).   In Hamrick, the trial court found that uninsured motorist coverage was not available under a policy issued to the driver's parents when the driver had their permission to drive the car during the parent's lifetime but the accident occurred nearly four years after the father's death and over one and one-half years after the mother's death.  The driver appealed the case to the Tennessee Court of Appeals where the trial court's decision was affirmed.
