William H. Tate obtained a verdict by way of a Motion for Summary Judgment in the United States District Court for the Middle District of Tennessee in the case of
Assurance Company of America v. Continental Development, Case No. 3:08-cv-0711. The Honorable Aleta A. Trauger, United States District Judge, granted the Motion denying coverage under the “intended or expected” exclusion of the Commercial General Liability Policy.
